About this course
The purpose of the course is to familiarize the student with the system of protection of fundamental rights built within the framework of the European Union. It is a system independent of national systems of human rights protection and systems of international protection. Despite its systemic independence, the system substantively draws on the experience and achievements of EU member states and the European system of human rights protection based on the European Convention on Human Rights. The systemic separateness of the protection of fundamental rights is due to the peculiarities of the EU as a supranational organization. Fundamental rights protected in this system include both first- and second-generation rights and are asserted when dealing with a so-called EU case. The basic normative act is the Charter of Fundamental Rights. However, for at least three decades, fundamental rights have been shaped and protected through case law by the European Court of Justice and its successor the Court of Justice of the European Union.
Expected learning outcomes
Student: – knows the concepts of human rights protection – knows the EU international protection system, human rights protection mechanism and jurisprudence standards Students are able to: – use correctly and understand basic concepts of protection of fundamental rights – define and recognize the system of protection of fundamental rights, the mechanism of protection of human rights built within this system using this knowledge in the professional work of an official – define and recognize the national system of human rights protection and mechanisms of its protection and analyze the relationship to the system of the European Union in the context of their use at work – define, recognize and analyze the jurisprudential standards of the Court of Justice of the European Union in the field of substantive human rights regulated by the Charter of Fundamental Rights, together with the mechanism of their control specified in EU law When resolving specific factual states, the student is able to interact in a group, lead a team, take actions to cooperate with the environment and resolve dilemmas related to the activities undertaken, improve the acquired knowledge and skills, including in the interdisciplinary aspect.
